ParkArmor Terms of Service

1. Acceptance of Terms

By downloading, installing, or using ParkArmor ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not install or use the App. These Terms form a binding agreement between you and Katafract LLC ("Katafract", "we", "us").

2. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted at https://katafract.com/terms/parkarmor with a revised date. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

3. License Grant

Subject to your compliance with these Terms, Katafract grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to install and use ParkArmor on Apple devices that you own or control, solely for your personal, non-commercial use.

The free tier of the App is licensed for use at no charge. ParkArmor Pro is licensed upon completion of the in-app purchase described in Section 5.

4. Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the App or its underlying software;
• Reverse-engineer, decompile, or disassemble the App except to the extent permitted by applicable law;
• Use the App for any unlawful purpose or in violation of any third-party rights;
• Remove or alter any proprietary notices or labels on the App;
• Use the App in any way that could interfere with traffic laws, safety regulations, or parking rules in your jurisdiction.

5. In-App Purchases

ParkArmor Pro is available as a one-time, non-consumable in-app purchase of $3.99 USD (or equivalent local currency), processed by Apple through the App Store.

• Payment is charged to your Apple ID account at the time of purchase confirmation.
• ParkArmor Pro is a permanent license tied to your Apple ID. You may restore it at any time on any device signed in to the same Apple ID using the "Restore Purchases" option in the App.
• Katafract does not receive, store, or have access to your payment information, Apple ID, or billing details. All payment processing is handled solely by Apple.
• Refund requests must be submitted directly to Apple via reportaproblem.apple.com. Katafract has no ability to issue or deny refunds.

6. Location Services

ParkArmor requests "When In Use" location access from iOS to record your parking coordinate when you save a spot. Location data is stored exclusively in local device storage and is never transmitted to any server or third party.

Location accuracy disclaimer: GPS accuracy depends on your device hardware, environmental conditions (tunnels, garages, urban canyons), and iOS location services. ParkArmor provides the GPS coordinate as reported by your device and makes no guarantee of precision. You are responsible for confirming your actual parking location.

ParkArmor does not request background location access and does not track your location while you are away from the App.

7. Notifications

The parking timer feature uses iOS local notifications (UNUserNotificationCenter). All notifications are scheduled and delivered on-device. No push notification server is used. Notification permission is optional — the timer will run without it, but you will not receive on-screen alerts. You may revoke notification permission at any time in iOS Settings.

8. Widgets

ParkArmor home screen and lock screen widgets display your saved parking data from local device storage via Apple's WidgetKit framework. Widget data is never shared with any external service. Widget availability depends on your iOS version and device model.

9. Safe Use

Do not operate ParkArmor while driving. Use the App only when your vehicle is safely stopped. Katafract is not responsible for any accidents, fines, towing, or other consequences arising from your use of or reliance on ParkArmor. Compliance with all applicable traffic, parking, and road safety laws remains solely your responsibility.

10. Intellectual Property

ParkArmor, the Katafract name, and all associated logos, designs, and software are owned by Katafract LLC and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App. All rights not expressly granted are reserved.

11. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KATAFRACT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT GPS LOCATION DATA WILL BE ACCURATE IN ALL CONDITIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KATAFRACT LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PARKING TICKETS, TOWING FEES, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF PARKARMOR, EVEN IF KATAFRACT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, KATAFRACT'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR PARKARMOR PRO.

13. Third-Party Services

ParkArmor is distributed through the Apple App Store and uses Apple's StoreKit framework for purchase processing. Navigation is handed off to Apple Maps via a standard iOS URL — no location data is shared with Katafract in that process. Your use of Apple's services is governed by Apple's Terms of Service.

14. Termination

This license is effective until terminated. It terminates automatically if you breach any provision of these Terms. Upon termination, you must stop using the App and delete all copies from your devices. Provisions that by their nature should survive termination (including Sections 10, 11, 12, and 15) will survive.

15. Governing Law

These Terms are governed by the laws applicable to Katafract LLC's principal place of business, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in that location.

16. Entire Agreement

These Terms, together with the ParkArmor Privacy Policy, constitute the entire agreement between you and Katafract with respect to ParkArmor and supersede all prior agreements and understandings.
